KAVACONNECT — LEGAL NOTICE AND TERMS OF USE

Welcome to KavaConnect. This Legal Notice and Terms of Use govern your use of the KavaConnect mobile application. Please read these Terms carefully before using the App.
1. ACCEPTANCE OF TERMS
By downloading, accessing, or using the KavaConnect mobile application (the "App"), you agree to be bound by these Legal Notice and Terms of Use (the "Terms"). If you do not agree to these Terms, do not use the App.
2. DESCRIPTION OF SERVICE
KavaConnect is a social check-in application that allows users to discover kava bars, check in or plan visits, notify friends, and connect with the kava community. Bar owners and kava tenders may manage bar profiles, events, and shifts. The App is provided on an "as-is" and "as-available" basis.
3. ELIGIBILITY
You must be at least 18 years old to use the App. By registering an account, you represent and warrant that you are at least 18 years of age and legally able to enter into a binding agreement.
4. USER ACCOUNTS
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate information during registration and to keep it updated. You may not create an account on behalf of another person or entity without authorization.
5. USER CONTENT
You retain ownership of content you submit to the App, including profile information, check-ins, messages, and photos. By posting content, you grant KavaConnect a worldwide, non-exclusive, royalty-free license to use, display, and distribute that content within the App as necessary to operate its features. You represent that you have the rights to all content you submit and that it does not violate any law or third-party right.
6. PROHIBITED CONDUCT
You agree not to: (a) use the App for any unlawful purpose; (b) post harmful, defamatory, harassing, or infringing content; (c) impersonate another person or misrepresent your affiliation; (d) attempt to access or disrupt the App's systems or data; (e) use automated means to scrape or extract data from the App; or (f) encourage or facilitate any of the above.
7. CHECK-INS AND LOCATION
Check-in features are voluntary. You are solely responsible for the accuracy of your check-ins and for deciding your visibility settings. KavaConnect does not guarantee the availability or accuracy of bar information, hours, or event details. Always verify directly with the venue.
8. BAR OWNERS AND KAVA TENDERS
Bar owners and kava tenders who claim or manage bar profiles are responsible for the accuracy of the information they provide. KavaConnect may verify, reject, or suspend bar claims at its discretion. Claiming a bar you do not own or operate is prohibited and may result in account termination.
9. THIRD-PARTY SERVICES
The App integrates with third-party services such as Google Maps, Google Drive, and Instagram. KavaConnect is not responsible for the availability, accuracy, or practices of these services. Your use of third-party services is subject to their respective terms and policies.
10. INTELLECTUAL PROPERTY
The App, its design, features, and underlying software are owned by KavaConnect and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the App without permission. Bar names, logos, and trademarks remain the property of their respective owners.
11. DISCLAIMERS
The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including fitness for a particular purpose or non-infringement. KavaConnect does not warrant that the App will be uninterrupted, error-free, or secure, or that any information is accurate or complete.
12. LIMITATION OF LIABILITY
To the maximum extent permitted by law, KavaConnect and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of or inability to use the App, even if advised of the possibility of such damages.
13. INDEMNIFICATION
You agree to indemnify and hold KavaConnect harmless from any claims, damages, or expenses arising from your use of the App, your content, or your violation of these Terms or any law or third-party right.
14. TERMINATION
KavaConnect may suspend or terminate your access to the App at any time, with or without cause or notice. You may delete your account at any time from Settings. Upon termination, your right to use the App ceases immediately.
15. CHANGES TO TERMS
KavaConnect may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date. Continued use of the App after changes constitutes acceptance of the revised Terms.
16. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law principles. You agree to the exclusive jurisdiction of the courts located in Florida for any disputes arising from these Terms or the App.
17. ENTIRE AGREEMENT
These Terms, together with the Privacy Policy, constitute the entire agreement between you and KavaConnect regarding your use of the App and supersede all prior agreements.

Child Saftey & CSAE Policy
1. Our Commitment to Child Safety
KavaConnect has zero tolerance for child sexual abuse and exploitation (CSAE) in any form. We are committed to maintaining a safe environment for all users and to upholding externally published standards against CSAE, including those defined by Google Play, the National Center for Missing & Exploited Children (NCMEC), and applicable federal and state laws.
2. Prohibited Content and Conduct
- Any content depicting, describing, or promoting the sexual abuse or exploitation of minors is strictly prohibited.
- Content that sexualizes minors, including suggestive imagery, animated depictions, or written descriptions, is not permitted.
- Grooming behavior, attempts to contact minors for sexual purposes, or any facilitation of abuse is prohibited and will result in immediate account termination.
- Links, code, or instructions directing users to CSAE content hosted elsewhere are also prohibited.
3. Age Restrictions
KavaConnect is intended exclusively for adults aged 18 and older. The app is not directed to, nor intended for use by, anyone under 18. We do not knowingly collect personal information from minors. If we become aware that a minor has created an account or provided data, we will take steps to delete that account and associated data promptly.
4. Content Moderation
User-generated content in KavaConnect includes profile photos, display names, bios, check-in messages, and bar event listings. We employ a combination of automated detection and human review to identify and remove prohibited content. Users can report inappropriate content or behavior directly through the app or by contacting us using the information in this policy.
5. Reporting and Response
If you encounter content or behavior that you believe violates these standards, please report it immediately. Reports can be submitted by emailing the developer contact listed on the Google Play Store listing or through the app's support channels. We review all reports promptly and take appropriate action, which may include content removal, account suspension, and referral to law enforcement.
6. Legal Compliance and Reporting to Authorities
KavaConnect complies with all applicable laws regarding the reporting of CSAE, including the reporting obligations under 18 U.S.C. § 2258A. Suspected CSAM (child sexual abuse material) is reported to the National Center for Missing & Exploited Children (NCMEC) via the CyberTipline, and to law enforcement as required.
7. Account Action
Users found to have violated this policy will have their content removed and their account permanently terminated. Repeat or severe violations may result in a ban from creating new accounts. Where appropriate, we will cooperate with law enforcement investigations.

9. Policy Updates
We may update this policy from time to time to reflect changes in law, platform requirements, or our practices. Material changes will be reflected by updating the "Last updated" date above.
